Welcome to The Man Who Stayed. These Terms set out the agreement between you and us when you visit this website, place an order, or interact with our content. We have tried to write this in plain English so you can read it without a law degree. If anything is unclear, email us at hello@themanwhostayed.com and a human will reply.

1. Acceptance of Terms

By accessing or using themanwhostayed.com (the “Website”) or placing an order, you confirm that you have read, understood, and agreed to these Terms, our Privacy Policy, and any policies linked from this page. If you do not agree, please do not use the Website.

You must be at least 18 years of age, or accessing the Website with the supervision of a parent or guardian, to place an order with us.

2. About Us

The Website and the book The Man Who Stayed are operated by Parbir Advisory Services (PHS) LLP(the “Company”, “we”, “us”, or “our”), a Limited Liability Partnership incorporated under the Limited Liability Partnership Act 2008 of India.

The book is authored by Sarabjeet Singh, CFA and published by BlueRose Publishers (Delhi · London).

3. Account & Guest Checkout

We do not require you to create a user account to shop with us. All orders are placed as a guest checkout. After an order is placed, we track it using a unique Order ID combined with the email address or phone number you provided.

You are responsible for keeping your Order ID and the email or phone number used at checkout safe. We will use the contact details you give us to send order updates, tracking information, and invoices. Please make sure they are accurate.

4. Use of the Website

You may use the Website for browsing, purchasing our books and related products, reading editorial content, and contacting us. You agree not to:

5. Orders, Pricing, and Availability

All prices on the Website are listed in Indian Rupees (INR) and are inclusive of applicable taxes, except where stated. The applicable Goods and Services Tax (GST) depends on the product:

Despite our best efforts, prices and product information may occasionally contain errors. If we discover a pricing or availability error after you place an order, we will contact you with the correct details and you may choose to confirm or cancel. We reserve the right to refuse or cancel any order at our reasonable discretion, including in cases of suspected fraud, breach of these Terms, or where a product is mispriced or out of stock.

6. Payments

We accept the following payment methods:

We never see or store your full card number, CVV, UPI PIN, or net banking credentials. Those are handled directly by Razorpay or Stripe under their own PCI-DSS-compliant systems.

Chargebacks. If you initiate a chargeback with your card issuer for an order that has already been delivered to you, we will share the full delivery record, AWB tracking, signature on delivery (where available), and unboxing evidence with the acquiring bank to defend the transaction. Fraudulent chargebacks may be reported to law enforcement.

7. Shipping & Delivery

We ship pan-India via Shiprocket and internationally via FedEx and DHL. Service availability, charges, expected delivery times, and tracking information are described in detail in our Shipping Policy, which forms part of these Terms.

8. Returns & Refunds

Our cancellation, return, and refund process — including timelines for damaged, defective, and wrong items — is described in our Refund & Cancellation Policy. Please read it carefully before placing an order, especially for digital products such as ebooks and audiobooks, and for personalised signed editions.

9. Intellectual Property

All content on this Website and in our products is protected by Indian and international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, transmit, modify, or create derivative works from our content without prior written permission, except as permitted under fair-dealing provisions of the Indian Copyright Act 1957 (such as short quotations for review, scholarship, or news reporting with proper attribution).

10. User Submissions

When you send us a review, testimonial, photograph, contact-form message, or any other content (a “Submission”), you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, edit (for length and clarity), and publish the Submission across our Website, marketing materials, social media, and retailer listings, with attribution to your first name and city unless you ask us not to use your name.

You confirm that any Submission is your own original work, does not infringe anyone’s rights, and is not defamatory, obscene, or unlawful. We reserve the right to decline, remove, or edit Submissions at our discretion.

11. Disclaimers

The Man Who Stayedis a work of fiction inspired by true events. All names, characters, companies, and incidents in the book are either products of the author’s imagination or used fictitiously. Any resemblance to actual persons, living or dead, or actual events, is coincidental except where used editorially with consent.

Nothing in the book or on this Website constitutes legal, financial, investment, tax, or professional advice. Read the book for the story it tells, not as a guide to running a company or managing money. For decisions that matter, consult a qualified professional. The Website and its content are provided on an “as is” and “as available” basis. We do not warrant that the Website will be uninterrupted, error-free, secure, or free from viruses, though we take reasonable steps to keep it so.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Parbir Advisory Services (PHS) LLP, its designated partners, employees, contractors, affiliates, suppliers, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including loss of profits, data, goodwill, or opportunity — arising out of or in connection with your use of the Website, the book, or any products purchased from us, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from or related to your order, the Website, or these Terms shall not exceed the total amount you paid us for the specific order giving rise to the claim. Nothing in these Terms excludes or limits any liability that cannot be excluded under Indian law, including liability under the Consumer Protection Act 2019 for defective goods.

13. Indemnification

You agree to indemnify, defend, and hold harmless Parbir Advisory Services (PHS) LLP, its designated partners, employees, and affiliates from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website, or your infringement of any third-party rights.

The Website may link to third-party websites — such as Amazon, Flipkart, Kindle, Google Play Books, social media platforms, and our payment or logistics partners. We provide these links for convenience and do not control or endorse the content, products, or practices of those third parties. 15. Governing Law and Jurisdiction

These Terms and any dispute or claim arising from them — including non-contractual disputes — are governed by the laws of India, including the Information Technology Act 2000, the Consumer Protection Act 2019, the Sale of Goods Act 1930, the Digital Personal Data Protection Act 2023, and the CGST, SGST and IGST Acts.

Subject to the consumer-protection rights you have under Indian law, the courts of New Delhi, India shall have exclusive jurisdiction over any dispute arising from these Terms or your use of the Website.

16. Modifications to Terms

We may update these Terms from time to time as our business, law, or practices change. When we do, we will update the “Last updated” date at the top. For material changes, we will make reasonable efforts to notify you — for example, by a banner on the Website or an email to recent customers. Continued use of the Website after changes are posted constitutes acceptance of the updated Terms.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid one that comes closest to the original intent.
